1. Agreement Overview

Welcome to FuelTrack.cloud, SaaS software which helps monitor, schedule, and optimize the use of vehicles, drivers, and control fuel usage. These Terms of Service (“Terms”) form a binding agreement between you (the customer) and us (the service provider).

Before creating an account or logging into software, or accessing any features of the platform, you must accept that you have thoroughly read and agreed to abide by these Terms of Service.

2. Who Can Use the Platform

You may use the platform if:

  • You are of legal age in your country to enter into contracts.
  • You are authorized by your company to manage or access fleet data.
  • You agree not to use the system in any way that interferes with other customers’ operations.

We reserve the right to refuse or terminate accounts if eligibility requirements are not met.

3. Your Responsibilities

As a registered user, you agree to:

  1. Keep your login credentials secure and do not share them outside your organization.
  2. Obtain any necessary permissions from employees or drivers before tracking location, mileage, or work hours through the platform.

4. Data & Ownership

  • You remain the owner of all operational data you upload to the system (e.g., GPS logs, fuel records, maintenance history).
  • By using the platform, you grant us permission to process and store this data for the purpose of delivering our services, generating reports, and maintaining system performance.
  • We may use aggregated and anonymized data to improve our algorithms, but this will never identify you or your employees personally.

5. Service Features & Changes

The platform may include features such as:

  • Fuel consumption and odometer monitoring
  • Maintenance scheduling and work order management
  • Driver performance analytics
  • Vehicle performance analytics

We may add, improve, or retire features based on technical, legal, or business requirements. Significant changes will be communicated in advance when possible.

6. Billing & Subscription Terms

  • Subscription fees are billed according to the plan and billing cycle you select.
  • If you choose to cancel your subscription before the end of the paid period, we will refund the unused portion of your payment, calculated on a pro-rated daily basis.
  • The refund amount will be determined as follows:

Refund = Total payment for the billing period – (Daily rate × Number of days used)

Daily rate = (Total payment ÷ Total days in billing period)

  • Example: If you paid $90 for a 30-day subscription and cancel after 10 days, your daily rate is $3.00. You will be refunded $60.00 for the 20 unused days.
  • Refunds will be processed to your original payment method within 5 business days after cancellation is confirmed.
  • If your account is terminated for a breach of these Terms, no refund will be issued.

7. Acceptable Use

You agree not to:

  • Use the platform to monitor individuals without their consent.
  • Modify, copy, or reverse-engineer any part of the platform.
  • Upload viruses, malware, or malicious scripts.

8. Downtime & Data Access

  • While we aim for high availability, the platform may occasionally be unavailable due to maintenance or unforeseen issues.
  • We recommend exporting critical reports regularly to ensure you have offline access to important records.

9. Termination of Service

We may suspend or terminate your account if:

  • You breach these Terms.
  • Required by law or regulatory demand.
  • Continued use poses security, legal, or operational risks to other users.

Upon termination, we will retain your data for a limited period in accordance with our data retention policy, after which it will be securely deleted.

10. Liability Limitations

  • The platform is a tool to assist with fleet operations, not a guarantee of compliance, safety, or performance.
  • We are not responsible for losses resulting from inaccurate data entry, user error, or misuse of the system.

12. Updates to the Terms

We may revise these Terms when we introduce new features or change how the platform operates. Updated Terms will be posted on our website with the new effective date.
